Mark Hamilton: "This one is definitely a potential single. It’s previous working title was Piano Song as Tim wrote the main hook line on a piano at U2’s villa in the south of France. The original dictaphone recording is also used in the intro of the track. There’s a underlining U2 vibe to the overall song so if it’s a hit then thank you Mr. President of the World for the inspiration and your regular hospitality! Lyrically is about being torn apart by a relationship failing. There’s a middle section that’s got military style drumming which builds up to a big final chorus. We’ve still to put strings on this track but it has the potential to fill stadiums. Fingers crossed the gods will be on our side..."
Rick McMurray: "It’s probably the most piano-driven thing we’ve done. I’d hesitate to call it a ballad, cos I think it’s a bit more upbeat than that, but it’s very anthemic, with lush, orchestral strings. It’s a great song."

CASI IN MATERIA DI FIDEIUSSIONE 21 maggio 2007; relatore avv. Michele Casalini ______________________________________________
- CASO 1 - L’Istituto di credito denominato A (creditore) concede alla società di capitali denominata B (debitore) un credito di importo pari a 100. Tale credito viene garantito dai soggetti denominati C, D, E, F (fideiussori) con sottoscrizione di atti di fideiussione. Il debito viene a scadenza e l’Istituto creditore A, conoscendo la difficile situazione finanziaria del soggetto debitore B si rivolge direttamente ai soggetti C, D, E, F richiedendo la corresponsione di 100, ma, non ricevendo il pagamento, rinnova l’intimazione ai soli soggetti C ed D tralasciando i soggetti E e F. C e D non pagano, sicchè l’Istituto A è costretto a ricorrere all’Autorità Giudiziaria al fine di richiedere decreto ingiuntivo contro la società debitrice B e tutti i fideiussori e quindi, in base al titolo ottenuto, iscrive ipoteca sui beni dei soggetti C e D. Pure a seguito di notifica del decreto ingiuntivo e del precetto i soggetti C e D non pagano, sicchè l’Istituto A procede con l’azione esecutiva immobiliare colpendo i beni immobili già ipotecati dei soggetti C e D. Le esecuzioni, pendenti avanti più Tribunali, dato che gli immobili dei soggetti C e D sono situati in città diverse, procedono in tempi differenti, talchè il realizzo ricavato dalla vendita coattiva dei beni del soggetto C viene ottenuto prima del realizzo dei beni del soggetto D. A fronte del credito di 100, l’Istituto A dalla vendita coattiva dei beni del soggetto C riceve 50; a questo punto il soggetto D, al fine di evitare la vendita coattiva dei propri beni, propone una transazione con l’Istituto di credito A offrendo 40, che viene accettata da A che si vede complessivamente pagare 90. Ciò posto in fatto, seguono le seguenti domande. ?A) In forza di quale principio il soggetto A indifferentemente può rivolgersi per ottenere 100 oltre che al debitore anche ai fideiussori. Ancora, i fideiussori avrebbero potuto esigere che il creditore, prima di aggredire i loro patrimoni, escutesse il debitore principale? ?B) Nell’ipotesi di unica fidejussione da parte di più soggetti, a garanzia del credito di 100, sarebbe possibile per questi obbligarsi nei confronti di A per importi diversi ed inferiori a 100? ?C) Pagato il credito di A, in via coattiva da parte del soggetto C e transattiva da parte del soggetto D (50+40), tali fideiussori contro chi possono rivalersi, e per quali importi? _____________________________________________
- CASO 2 - L’Istituto di credito denominato A (creditore) concede al soggetto B (debitore) un credito di 100. A fronte di ciò ottiene un’ipoteca volontaria su di un immobile del soggetto B e ottiene una fideiussione dal soggetto C. Il credito viene a scadenza e, non pagato né da B né da C, il creditore A ottiene un decreto ingiuntivo ed iscrive ipoteca giudiziale sui beni immobili del fideiussore C. Viene quindi promossa azione esecutiva immobiliare sui beni di B e C, ma C nel corso dell’esecuzione riscontra che il creditore A ha rinunciato al pignoramento promosso nei confronti di B ed ha rinunciato altresì all’ipoteca iscritta sui beni di questi sottoposti ad esecuzione. Tale comportamento di A lede una posizione giuridicamente tutelata di C ? In caso di risposta positiva, quali iniziative può intraprendere C ?
